SkyHigh User Agreement

By creating a SkyHigh account, installing SkyHigh software, or connecting to the SkyHigh Network, you agree to be bound by this User Agreement, the Code of Conduct, and the Code of Regulations (together, the “SkyHigh Policies”).

If you do not agree to these terms, you must not create an account or use any SkyHigh services.

SkyHigh provides a voluntary, non-commercial virtual aviation network for entertainment and educational purposes only.

SkyHigh is not an air navigation service provider and must not be used for real-world air traffic control or operational decision-making.

SkyHigh may modify, suspend, or discontinue any part of the service at any time without notice.

You represent that the information provided during registration is accurate and complete, and that you have the legal capacity to enter into this Agreement.

Where required by law, minors may only use the network with appropriate parental or guardian consent; SkyHigh may limit access for minors at its discretion.

SkyHigh may refuse membership or access where necessary to protect the network or comply with legal obligations.

Subject to your continuing compliance with the SkyHigh Policies, SkyHigh grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the network and to install and use official SkyHigh software clients solely for personal, non-commercial use in connection with the network.

You may not copy, modify, distribute, sell, or lease any part of the SkyHigh software or services except as expressly permitted by SkyHigh.

You must not use the network for any unlawful purpose, attempt to gain unauthorised access to any SkyHigh systems or data, reverse engineer or decompile SkyHigh software except where permitted by law, or use the network in a manner that could damage, disable, or overburden SkyHigh systems.

You must not commercially exploit the network, including by charging others for access or using it to promote commercial training, unless expressly authorised by SkyHigh in writing.

SkyHigh retains all rights, title, and interest in its trademarks, logos, software, and other original content.

Where you submit content, including procedures, documentation, or code, for use by SkyHigh, you grant SkyHigh a non-exclusive, worldwide, royalty-free licence to use, modify, and distribute that content in connection with the network, subject to any specific contribution agreements.

You are responsible for ensuring that content you contribute does not infringe the rights of third parties.

SkyHigh will process personal data in accordance with UK data-protection law, including the UK General Data Protection Regulation and the Data Protection Act 2018, and in line with any privacy notices published on the SkyHigh website.

You understand that SkyHigh may log your connections, communications, and activity on the network for operational, training, security, and abuse-prevention purposes.

SkyHigh may transfer and store personal data on servers located inside or outside the United Kingdom. Where data are transferred outside the UK, SkyHigh will take reasonable steps to ensure an adequate level of protection consistent with UK data-protection requirements.

You may have rights under UK data-protection law, including the right to access, rectify, or erase your personal data, to restrict or object to processing, and to data portability, subject to certain limitations. Requests to exercise these rights should be submitted through the channels published by SkyHigh.

SkyHigh may retain certain personal data for a reasonable period after account closure where necessary for legitimate interests such as security, fraud prevention, dispute resolution, and compliance with legal obligations.

The SkyHigh Network and all related services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

SkyHigh does not warrant that the services will be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by law, SkyHigh and its volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the network, including loss of data, simulator crashes, or missed virtual flights.

Nothing in this Agreement limits liability which cannot be excluded under applicable law.

You may terminate this Agreement at any time by ceasing to use the network and requesting closure of your account.

SkyHigh may suspend or terminate your account, or restrict access to specific services, where you violate the SkyHigh Policies or where required by law or technical necessity.

Upon termination, your licence to use the network and software automatically ends. SkyHigh may retain minimal data as necessary for legitimate interests such as security, fraud prevention, and legal compliance.

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

You and SkyHigh agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such dispute or claim.

SkyHigh may update this User Agreement from time to time.

Material changes will be announced on official channels, and continued use of the network after the effective date of any change will constitute your acceptance of the updated terms.
